Distance Selling Agreement
These Terms and Conditions are effective as of July 26, 2025.
Maika Endo, with a principal place of business at Silahşör Caddesi No: 42 / 1 Şişli/ İstanbul, Turkey ("Seller", "we", "us", or "Company"),
and
You ("Buyer").
WHEREAS, Seller operates an online website located at maikaendo.co and maikaendo.com (the "Website") that offers digital courses for purchase.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows:
1. Sale of Digital Courses
1.1 Seller agrees to sell and Buyer agrees to purchase the digital courses identified on the Website (the "Courses") subject to the terms of this Agreement.
1.2 Descriptions, learning objectives, and details of each Course are available on the Website.
1.3 Seller grants Buyer a non-exclusive, non-transferable, revocable license to access and use the Courses for personal or internal business purposes only.
1.4 Buyer agrees not to modify, reproduce, reverse-engineer, distribute, or create derivative works from the Courses.
1.5 Redistribution, resale, or public display of the Courses is prohibited without prior written consent from Seller.
2. Price and Payment
2.1 Course prices are listed on the Website and are subject to change without notice.
2.2 Payment must be made in full via the available payment methods on the Website.
2.3 Payment is due immediately upon purchase.
3. Delivery of Digital Courses
Upon successful payment, the Courses will be delivered electronically, either via immediate access on the Website or via email.
By purchasing and accessing the digital content, the Buyer expressly consents to immediate delivery and acknowledges that this access results in the loss of the 14-day right of withdrawal under EU law (Directive 2011/83/EU, Article 16(m)).
It is the Buyer's responsibility to ensure they have suitable internet access and compatible devices to use the Courses.
4. Cancellation and Refund Policy for Digital Products/Courses
4.1 EU, UK, and Turkish Customers:
If you are a resident of the European Union, United Kingdom, or Turkey, you have the right to withdraw from this contract within 14 days of purchase without providing any reason — even if you have accessed or downloaded the content.
To exercise this right, email support@maikaendo.co with a clear statement. You may use the model withdrawal form below, though it is not mandatory.
Refunds will be issued within 14 days to your original payment method. If your withdrawal is valid, access to the course will be revoked, and you must delete all copies of the materials received.
4.2 Buyers Outside the EU, UK, and Turkey:
Buyers residing outside these jurisdictions may request a refund within 14 days of purchase, provided they have not made substantial use of the Course. Substantial use includes but is not limited to:

Streaming or viewing more than 20% of video content,

Downloading key course files (e.g., workbooks, templates, lesson PDFs),

Completing interactive exercises, assessments, or certification tasks.
If you meet these conditions, contact support@maikaendo.co with your order number and refund reason. Approved refunds will be issued within 14 days to your original payment method, minus any payment processing fees unless otherwise required by law.
Buyers outside the EU, UK, and Turkey are eligible for only one voluntary refund, regardless of the number of products or services purchased. This does not affect any rights granted by consumer protection laws in your country of residence.
5. Intellectual Property
5.1 All content provided via the Website and Courses—including text, graphics, videos, templates, and software—is the intellectual property of the Seller or its licensors.
5.2 Buyer may not alter, remove, or obscure any copyright notices or proprietary labels.
6. Disclaimer
6.1 The information provided in the Courses and on the Website is for educational and informational purposes only.
6.2 Seller makes no guarantees regarding results, outcomes, or the applicability of the content to any specific situation.
6.3 Buyer assumes full responsibility for their decisions and actions based on the Course content.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Seller shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to the use of the Website or Courses, even if advised of the possibility of such damages.
8. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any dispute, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
9. Entire Agreement
This Agreement constitutes the entire agreement between the parties regarding the subject matter and supersedes all prior agreements or understandings.
10. Amendments
We may amend these terms at any time by posting the revised version on the Website. Continued use of the Website or Courses after the changes take effect indicates acceptance of the new terms.
11. Severability
If any part of this Agreement is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Notices
All legal or contractual notices must be sent in writing to:

13. Right of Withdrawal (EU Customers Only)
If you are a resident of the European Union, you have the right to withdraw from this contract within 14 days of purchase without giving any reason, provided you have not accessed or downloaded the content.
To exercise this right, notify us at support [at] maikaendo.co. You may use the form below.
By accessing or downloading digital content during this period, you consent to immediate delivery and acknowledge that this waives your withdrawal right under Article 16(m) of the Directive.
